Acceptable Use Policy

This English version is provided for convenience. In case of doubt, the German version prevails.
This Acceptable Use Policy is part of our terms and conditions. It protects our customers, our infrastructure and the public from misuse. It applies to all CheapTopHost services, including web hosting, managed cloud servers, email services and domains, and to all persons to whom the customer grants access to their services.
1. Illegal content
It is prohibited to store, publish, distribute or link to content that violates applicable law, in particular:
- depictions of sexual abuse of children and young people, and content harmful to minors without effective age verification,
- content inciting hatred, terrorism or violence, and symbols of unconstitutional organisations,
- insulting, defamatory content or content that infringes personality rights,
- offers of illegal goods and services (e.g. narcotics, weapons, forged documents, stolen data),
- unlicensed gambling and fraudulent offers (e.g. fake shops, pyramid schemes),
- content that violates data protection, competition or consumer protection law.
2. Spam and email abuse
- Sending unsolicited bulk or advertising emails (spam) is prohibited. Advertising emails may only be sent to recipients who have demonstrably consented (double opt-in).
- Forged sender details, operating open relays and using purchased or harvested address lists are also prohibited.
- Websites advertised through spam may not be hosted with us.
- A dedicated mailing service must be used for large newsletters. We may set technical limits on the number of emails sent per hour.
3. Malware, phishing and attacks
The following are prohibited in particular:
- distributing or hosting malicious software (viruses, trojans, ransomware, exploit kits),
- phishing pages and other pages that request access or payment details under false pretences,
- attacks on other systems, e.g. denial-of-service attacks, port and vulnerability scans without the operator's permission, brute-force attacks or unauthorised intrusion into third-party systems,
- botnet control, proxy or VPN services for third parties, and anonymising services that facilitate abuse.
4. Crypto mining and similar applications
Mining cryptocurrencies, running blockchain nodes and similar compute-intensive continuous processes are not permitted on our hosting plans. This also applies to scripts that run mining in website visitors' browsers.
5. Excessive resource usage
- Our hosting plans are intended for operating websites, online shops and mailboxes. Even for resources described as "unlimited", reasonable use within the technical limits applies (§ 4 of the terms).
- In particular, the following are not permitted:
- use as pure file, backup or archive storage unrelated to a website,
- download, file-sharing or streaming services for large amounts of data,
- permanently running background processes, game servers or chat servers,
- scripts or cron jobs that place a disproportionate load on the servers.
- For projects with high resource requirements, we recommend our managed cloud servers.
6. Copyright and trademark rights
- Content may only be stored and published if the customer holds the necessary rights. In particular, offering copyrighted works (software, films, music, books, images) without a licence and infringing trademark and name rights are prohibited.
- Rights holders can report infringements by email to support@cheaptophost.com. The report should include the address concerned (URL), the right infringed and details of the rights holder.
7. Account security
The customer keeps the software they use up to date, uses secure passwords and fixes known security vulnerabilities without delay. If an account is compromised, the customer cooperates in cleaning it up.
8. Consequences of violations
- In the event of violations of this policy, we may – taking into account the severity of the violation and the customer's legitimate interests – take the following measures in particular:
- notifying the customer with a request to remedy the situation within a reasonable period,
- removing or blocking individual content or files,
- temporarily limiting resources or email sending,
- temporarily suspending individual websites or the entire account (§ 11 of the terms),
- terminating the contract for good cause in the event of serious or repeated violations (§ 8 (6) of the terms).
- In the event of acute danger (e.g. malware, phishing, ongoing spam), we may act immediately and inform the customer afterwards.
- If we suspect criminal offences, we may inform the competent authorities. Statutory disclosure obligations remain unaffected.
- Further claims, in particular for damages and indemnification (§ 5 (5) of the terms), are reserved.
9. Reporting violations
You can report abuse or illegal content on websites hosted with us at any time by email to support@cheaptophost.com. Please state the address concerned (URL), a description of the violation and any evidence.
